Terms of Use

These terms apply when you use an app published by MADE BY MATTER PTY LTD (ACN 699 846 896), including Nitpick. By using the app you agree to them. If you do not, please do not use it.
What Nitpick is
Nitpick is a daily word puzzle. One set of puzzles is published each day. It is free to download and free to play. There is nothing to buy inside it and it shows no advertising.
Your account
You can play without an account. If you create one, you are responsible for keeping your sign-in details secure. Tell us at hello@madebymatter.com.au if you believe someone else has used your account.
You may delete your account at any time from Settings, or through our deletion request page if you have already uninstalled the app. Deleting is permanent and removes your streak and history.
Fair use
Please do not attempt to extract puzzle answers from our servers, automate play, interfere with the service, or use the app in a way that breaks the law. Puzzle answers are held server-side, and probing for them is not fair play.
We may suspend access if the service is being abused in a way that affects other players.
Streaks and results
Your streak is a record of the days you have played. We do our best to keep it accurate, but it depends on your device's clock and your connection. A streak has no monetary value and cannot be transferred or exchanged.
What we own
The puzzles, the app, its name and its design belong to MADE BY MATTER PTY LTD. You may share your results, including the emoji grid the app produces. Please do not republish the puzzles themselves.
Availability
We aim to publish a new set every day, and to keep the service running. We cannot promise it will always be available or error-free. We may change or discontinue the app, and if we discontinue it we will give reasonable notice in the app where we can.
Your rights under Australian Consumer Law
Nothing in these terms excludes, restricts or modifies any guarantee, right or remedy you have under the Competition and Consumer Act 2010 (Cth) or any other law that cannot be excluded.
Our goods and services come with guarantees that cannot be excluded under the Australian Consumer Law. Where we are permitted to limit our liability, and to the extent the law allows, our liability is limited to resupplying the service or paying the cost of having it resupplied.
Because Nitpick is provided free of charge, and except as set out above, we are not liable for indirect or consequential loss arising from your use of it.
Apple and Google
If you downloaded Nitpick from the App Store or Google Play, that store's own terms also apply to your download. Apple and Google are not responsible for the app, and any support question should come to us rather than to them.
Privacy
Our Privacy Policy explains what we collect and why. It forms part of these terms.
Changes
We may update these terms. If we do, we will change the date at the top of this page, and if the change is significant we will tell you in the app. Continuing to use the app after a change means you accept the updated terms.
Governing law
These terms are governed by the laws of Queensland, Australia. If you are a consumer in another country, you keep the benefit of any mandatory consumer protections that apply where you live.
